1. Understanding the scope of the client's control over the subcontractor's financial security

1.1 Principles of acceptance and approval

The legislator has introduced provisions to protect subcontractors, by requiring the main contractor to present its subcontractors to the client for acceptance, and to have their terms of payment approved by the client (article 3 of the loi n° 75-1334 du 31 décembre 1975 modifiée law on subcontracting).

But for these provisions to apply :
