This new legal and regulatory framework for the protection of business secrecy can only be welcomed, as it has sought to protect companies by enabling them to preserve the confidentiality of information that cannot be protected under intellectual property law (patents, designs, copyright), but which is nonetheless important for maintaining their competitiveness.

Armed with this new legal arsenal, companies need to put in place a genuine internal and external strategy to preserve business secrecy and be able to claim its benefit before a court in the event of litigation.
