4. Manage proof of counterfeiting

Prior to any proceedings, and precisely in order to avoid any destruction of evidence by the alleged infringer on receipt of the summons, it is important to gather evidence of the acts of infringement and their extent.

Infringement may be proven by any means (article L. 615-5 of Code de la propriété intellectuelle ), such as bailiff's reports, witness statements, commercial documentation or expert reports (amicable or judicial).
