4. Who benefits from intellectual property rights?

Although copyright and design rights can protect the same object, the rules for determining the beneficiary of each of these rights are not identical.

4.1 Copyright owner

In France, there is a legal presumption of creator status: authorship is presumed to belong to the person or persons under whose name the work is disclosed ( article L. 113-1 du CPI ).

Copyright therefore belongs first and foremost to the author (or, failing that, to his or her heirs). It is then up to the author to assign or license his or her economic rights in the work.
