3. What do we mean by "employer"?

The determination of the employer is far from indifferent, since it will determine in particular :

  • the beneficiary of the right to the title (mission invention) or of the right of attribution (invention outside attributable mission);

  • the person to whom the employee must declare his invention.

Code de la propriété intellectuelle refers to the employer, i.e. the natural or legal person bound by an employment contract to the employee, who is placed under its hierarchical authority.
