5. What are the effects of the opposition procedure?

The opposition procedure has three possible outcomes ( article 101 de la CBE ):

  • patent revocation (28% of cases in 2016);

  • maintaining the patent and rejecting the opposition (32% of cases in 2016);

  • maintaining the patent in a modified form (40% in 2016).

In all cases, the Opposition Division's decision is formulated in writing and notified to the opponent and the patentee.
