3. How to write a description of the invention?
The description of the invention is written on plain paper. The description is essential, and its drafting is of prime importance, as it serves as the basis for the claims. Consequently, whatever amendments are made to the claims during the examination phase, the description may not be modified except in cases expressly provided for by the French Intellectual Property Code.
It must be :
sufficiently precise to enable a person skilled in the art to carry out the invention, failing which the patent, even if granted, may be revoked;
to support all the technical means to be implemented and to anticipate any changes in claims.
