5. ICPE and water nomenclature

Under water-related regulations, certain activities, works or structures are subject to authorization or declaration, depending on their classification in the Water nomenclature. ICPEs are excluded from this nomenclature. They are subject only to the ICPE authorization and declaration regimes set out in Title I er of Book V of the Environment Code (codification of Law no. 76-663 of July 19, 1976). The circular of February 8, 1995 confirms this interpretation: "Classified installations are no longer subject to the nomenclature of the water law, nor to the authorization and declaration regimes which derive from it".

The conditions under which ICPEs are commissioned, operated and closed down must comply with the provisions of the Water Act, which aims to achieve balanced water management objectives. This compliance is ensured...
