8. Mistakes to avoid

8.1 Don't forget to inform your insurer immediately

As a preliminary point, it should be remembered that as soon as the company receives the letter from the Caisse primaire d'assurance maladie informing it that the victim intends to request recognition of the employer's inexcusable fault, it should send a claim declaration to the insurer so that the latter can take charge of the procedure.

If you fail to do so, your company will not be covered by its insurer, and any compensation it may be ordered to pay as a result of inexcusable fault will not be paid by the insurance company. Don't forget to check whether your insurance policy (civil liability of the company director) includes an extension clause covering inexcusable fault on the part of the employer....
