4.1 Avoid litigation and cancellation of the procedure
It is up to the prefect (or his department) to define the communes in which the notice informing the public of the opening of a public inquiry following the filing of a DAE is to be posted, and in which the municipal councils are to be consulted. If a commune fails to post or consult its municipal council, there's a good chance that the whole procedure will have to be repeated. This is why it is advisable for the dossier writer to identify these communes and list them in the dossier.
