What do you have to do when your existing classified facility subject to authorization becomes a registered facility due to a change in the nomenclature?

The circular dated September 22, 2010 clarifies the application of the rule of anteriority:

  • For facilities changing from authorization to registration, the operator must notify the prefect within one year of the entry into force of the new heading. The requirements of the prefectoral authorization order remain applicable to the site. However, the requirements made applicable to existing facilities by the ministerial decree on general requirements apply automatically. The mechanism is the same for facilities subject to declaration.
