1. Determine the legal status of the "water" nomenclature project

The legal regime governing water is set out in Title I er of Book II of the Code de l’environnement , entitled "Water and aquatic and marine environments". Chapter 3, more specifically devoted to "activities, installations and uses", describes the regimes applicable to the various projects.

Three types of "water law" regimes exist in France:

  • No procedure, when projects have little or no impact on water and aquatic environments. In this case, you can carry out the work without informing the authorities.

  • Declaration , for projects with a slight impact on water resources. You must then submit a declaration...
