6.1 Managing modifications: substantial versus non-substantial

Over the course of its operational life, an energy facility undergoes changes (addition of a production line, change in the type of fuel, etc.). The operator has a legal obligation to report any modification to the prefect before it is implemented (Article R. 181-46 of the Environmental Code [https://www.legifrance.gouv.fr/codes/article_lc/LEGIARTI000048873490]).

  • Non-substantial modification: If the change results in a minor increase in emissions or risks, the authority may simply issue a supplementary prefectural order (APC) to adjust the initial requirements.
