Partnership contracts and traditional public procurement contracts

The partnership contract differs from the traditional public procurement contract in two respects.

• First of all, unlike the holder of a conventional public contract, the holder of a partnership contract is himself the project manager for the work to be carried out, which constitutes a derogation from Article L. 2411-1 of the CCP, which requires public bodies to be the project manager for the works they have built.

• Secondly, a partnership contract differs from an ordinary public works contract in that it allows payment for the work to be spread over the duration of the contract (art.
