11.  Roles, responsibilities, and obligations

11.1  Contractor's liability

The obligations of waste producers are based on three main principles:

  • the responsibility of the producer or holder;

  • the polluter pays principle;

  • extended producer responsibility (EPR).

The Environmental Code stipulates: "All producers or holders of waste are responsible for managing this waste until its final disposal or recovery, even when the waste is transferred to a third party for treatment." It is therefore up to the contractor to ensure that their service provider is authorized to handle their waste and that it is managed in accordance with regulations.
