Legal and ethical aspects

The use of generative AI software raises both legal and ethical issues.

The European AI regulation (AI Act) aims to take better account of generative AI by imposing transparency rules. These rules concern the need to clearly inform users that they are communicating with a machine, particularly for vulnerable people (the elderly, children) likely to be more easily deceived. These users may thus be led to make biased decisions or follow biased recommendations.

In addition, companies developing generative AI systems would be required to specify whether the data used to develop their systems is protected by copyright (scientific texts, music, photos, etc.). With regard to this data, Europe has issued the General Data Protection Regulation (GDPR), which ensures the protection of all personal data.
