INTRODUCTION
Anyone owning or operating a plant, whether industrial or not, must check its administrative status with regard to facilities classified for environmental protection under the French Environment Code, before starting up. To do so, they must consult the nomenclature of classified facilities established by decree of the Conseil d'Etat.
What does the term "standard bylaw" mean?
Depending on the seriousness of the hazards and inconveniences that an operation may present, there are several possible cases. If the company is subject to declaration (D) or declaration with periodic inspection (DC), specific regulations apply: the arrêté type.
If at least one of the installations is subject to declaration, and none of them exceeds an authorization threshold, the installation is subject to declaration (D) or declaration with periodic inspection (DC). In this case, the operator must compile a declaration file, which is submitted to the prefecture. Once the dossier has been checked for conformity, the prefect issues a receipt for the declaration. From this point onwards, the operator must comply with the requirements of the standard decree for the heading(s) in question.
