3.1 Check the proportionality of noise regulations
The possibility for an administrative authority to impose requirements relating to noise pollution is limited, on the one hand, by the illegality of general and absolute prohibitions (e.g. prohibition of noisy activities), and on the other hand, by the necessary proportionality of the measure to the pollution observed (e.g. only the exceeding of emergence limit values and the existence of complaints from local residents justify the obligation to bring the air extractor fan in the premises into compliance).
