4. Establish public utility easements

When applying for an operating permit, the establishment may request the establishment of public utility easements for a classified facility to be set up on a new site.

The public utility easement, a tool of Code de l’urbanisme , makes it possible to prohibit construction within the perimeter defined by the easement. The applicant for authorization must indicate the desired perimeter and rules for the establishment of easements.

The procedure for establishing the easement requires the opinion of the municipal councils of the communes within the perimeter of the easement, as well as a public inquiry. The easement is then approved by the prefect and appended to the local urban development plan.
