1. The victim of pollution or non-compliance

The victim is the person who suffers the damage caused by the pollution or non-compliance of your installation.

It can report the situation to the administrative authority in charge of ICPE control, which will trigger an inspection visit by the ICPE inspector. This visit may result in you being held administratively and/or environmentally liable.

Please note

The victim of pollution or non-compliance at your facility can never take action on the basis of environmental liability. They can only alert the administrative authorities to the existence of environmental damage, independent of the harm they have suffered. It is then up to the administrative authority to implement your environmental liability, if necessary, which can then be combined with your administrative, civil or criminal liability....
