Can the prefect refuse a declaration on the grounds that the installation has not been inspected?
No, as long as the declaration is in order and complete, the prefect is obliged to issue the operator with a declaration receipt. The prefect has "tied competence", which means that he cannot invoke the need to protect the environment. If the prefect considers that the proposed facility is not included in the nomenclature of classified facilities, or falls under the registration or authorization regime, he notifies the interested party. If it falls under the registration regime, the operator must submit a registration file; if it falls under the authorization regime, he must submit an authorization application file.
