7. What is the time limit for taking action?

The period during which it is possible to seek the liability of the author of an act of infringement is limited in time:

  • Civil action for infringement is barred after 5 years from the date of the infringement (article L. 615-8 of Code de la propriété intellectuelle );

  • criminal infringement proceedings are time-barred after 6 years, starting from infringement acts committed either after March 1 er 2017 or which were not time-barred on March 1 er 2017 under the old law, which provided for a 3-year limitation period (articles 8 and 112-2 of
