4. What are everyone's obligations?

The invention declaration gives rise to rights and obligations for both the employee and the employer.

First of all, regardless of the outcome of the classification procedure, both employee and employer are required to :

  • strict confidentiality: they must refrain from any disclosure likely to compromise in whole or in part the exercise of rights over the invention;

  • an obligation of loyalty: employee and employer must provide each other with all useful information on the invention in question, in order to ensure its classification (article L. 611-7, 3 of Code de la propriété intellectuelle ).
