3. What happens next?

The date on which the invention is declared is very important, as it is this date that starts the clock ticking, enabling the employer to decide on the proposed classification and, where applicable, to exercise his right of attribution (invention outside attributable mission).

3.1 Classification decision

On receipt of the invention declaration, the employer has two months in which to :

  • agree to the classification of the invention proposed by the employee inventor;

  • in the absence of an indication of the classification, inform the employee of the classification he or she has chosen by means of a reasoned communication (article R. 611-6 al. 1 of
