2. In the event of a dispute, determine the method of dispute settlement

Despite upstream measures, disputes over employee inventions cannot always be avoided.

However, these must be distinguished from other disputes that may arise between an employee and his or her employer, and several methods of dispute settlement are possible.

While arbitration is generally ruled out in practice because of the imbalance that generally exists between the parties, it is possible to envisage, successively or alternatively, a settlement through conciliation or litigation.
