5. What is the scope of the protection afforded by a CCP?
Although the SPC is closely linked to the patent from which it derives, the protection it confers is not equivalent. In other words, the SPC is not an extension of the patent's validity as such, but an addition to protection restricted solely to the product covered by marketing authorizations obtained before the SPC expired ( article L.611-3 du CPI or article 4 des règlements (CE) n°469/2009 and n°1610/96 ).
