8. What are the formalities for obtaining a CCP?
As already mentioned, a CCP is a national title. It must therefore be applied for directly from the national intellectual property office of the country of interest.
Typically, in France, filing formalities are fairly straightforward, and no drafting is required, unlike for patents. You need to fill in a request for issuance on the online portal of the Institut national de la propriété industrielle (INPI) (tab "déposer une demande, puis CCP").
The form must indicate the name of the applicant, the product to be covered by the SPC, details of the patent on which the SPC is based, the date and number of the MA relating to the product in France and/or the date and number of the MA relating to the 1 re authorization in the European Community.
