5. Change from A authorization to AS authorization with servitudes

A facility covered by the authorization regime may be transferred to the authorization with servitudes regime following a lowering of the thresholds for the relevant heading.

In this case, you can retain the benefit of prior rights, provided you inform the prefect of your situation within one year of publication of the decree amending the nomenclature. The requirements of the prefectoral authorization order remain applicable, but the prefect may, in view of the risks presented by the facility, request the production of additional information and studies, or reinforce the requirements applicable to the facility.
