1. Conversion from declaration D to authorization A

If thresholds are lowered or harmonized as part of a revision of the nomenclature, a classified facility covered by the declaration regime may fall under the authorization regime.

In this case, the plant can benefit from grandfathering rights. This principle allows the plant to continue operating under its former regime, without having to go through the full procedures associated with legislation on classified installations (in this case, filing a full authorization dossier). Prior rights apply on condition that you have informed the prefect of this change of regime within one year of publication of the decree amending the nomenclature.
