4. Ensure medical surveillance of temporary workers

If you employ a temporary worker in a position subject to SMR (e.g., to replace an employee you have already identified as being under reinforced medical supervision), you must inform the temporary employment agency (article D. 4625-19 of Code du travail ).

As the user company, you will be responsible for working with your occupational physician to organize reinforced medical surveillance for the temporary worker's position (in this case, the fitness report issued by the ETT's occupational physician alone will not be sufficient: it is your occupational physician who will decide whether the temporary worker is fit for the job – article R. 4625-12
