5. How can you be sure that your MSDSs have been received?

• If you manage SDSs in paper form, the registered letter with acknowledgement of receipt is proof of the date the SDS was sent and the date it was received by the recipient. Keep the AR carefully!

• If you manage MSDSs in electronic format, you should be aware that there is no such thing as a simple, automatic electronic acknowledgement of receipt today, as computer protocols are not perfectly standardized. E-mails are increasingly being challenged in the courts.

One solution is to use the services of a third party (a trusted third party and/or a third-party archiver), who will act as a kind of witness and enable this procedure to be contractualized in an evidence agreement with your customers.
