3. How to transmit SDS?
ECHA's SDS development guidance (December 2020) makes it clear that the wording "an SDS is provided" is to be understood as a proactive obligation on the part of the supplier to actually provide the SDS (and any required updates). The ECHA forum therefore concluded that simply putting a copy of an SDS (or an SDS update) on a website would not be considered to be in compliance with the obligation to "provide" an SDS. In the case of electronic "supply", it is therefore acceptable to provide the SDS (and any attached exposure scenario) as an e-mail attachment or as a direct, specific, persistent link that does not impede access to the SDS, e.g. no identifier or registration may be required.
