2. Identify public or private purchasers subject to the Public Order Code

This text applies to contracts concluded by public or private "purchasers", a new term covering both contracting authorities and contracting entities.

The contracting authorities subject to these provisions are, by and large, legal persons governed by public law, legal persons governed by private law created specifically to meet needs in the general interest, other than those of an industrial or commercial nature, and bodies governed by private law with legal personality set up by contracting authorities with a view to carrying out certain activities jointly.

Contracting entities are contracting authorities, public companies and certain private-sector organizations that operate networks.
