5. Regulatory developments

Classified facility regulations are constantly evolving, in order to comply with EU directives, take account of industrial accidentology and best available techniques, and simplify administrative procedures. The regulatory watch carried out by operators of classified facilities must focus primarily on changes to the nomenclature and directly applicable technical requirements. However, it must not obscure certain environmental rules that fall outside the scope of classified facility legislation.

5.1 Changes to the ICPE nomenclature (grandfathering)

Grandfathering applies to facilities which, after having been duly commissioned, are subject to authorization, registration or declaration by virtue of a decree relating to the nomenclature of classified facilities....
