4. Change of operator

Authorizations, registrations and declarations are "real" in nature, i.e. they concern the classified facility as such, and not the individual operator.

The French Environment Code (article L. 511-1) refers above all to "installations operated or held", and case law gives precedence to the notion of "operator".

Example:

the owner of a former gravel pit operated by his grandfather until 1956 had allowed several companies to deposit waste and fill on the site. As the sole beneficiary of this waste deposit, he must be considered as the de facto operator of an unauthorized classified facility, and the authorities may impose site monitoring requirements (Nancy Administrative Court of Appeal, August 2, 2007, no. 05NC01103).
