Is the prefectoral decree valid throughout the life of the classified facility?

The prefectoral decree is issued when the facility is created (except in the case of administrative regularization) and remains valid indefinitely. However, the initial order may be amended (by adding or deleting requirements) by means of a supplementary prefectoral order.

In particular, this procedure is initiated in the following cases:

• substantial modification of activity resulting in a significant change in the conditions of authorization ;

• modification of a national regulation on which the order is based and which modifies the technical requirements it contains;

• creation of a new regulation that imposes the application of new requirements...
