3. Check that your invention idea is patentable

In order for your invention idea to be eligible for a patent application, it must not fall within the scope of the statutory exclusion from patentability.

In fact, the invention may not be patentable if it is not of a technical nature, or if it turns out to be the implementation of an intellectual process that is not of a technical nature.

For example, discoveries, scientific theories and mathematical methods, aesthetic creations, plans, principles and methods for carrying out intellectual activities, games or economic activities, as well as computer programs and presentations of information, are not considered patentable in France and before the EPO when the patent application concerns only one of these elements as such (see Scientific theory, marketing method, software...
