5. Define the territory(ies) envisaged for patent protection

Patent protection is subject to the principle of territoriality, which means that the title granted will be governed by the law of the State in which it is applied for. Moreover, according to this principle, its effects will be limited to the territory for which it has been granted.

This is why, before taking any steps, it is advisable to analyze and project the future use of the invention, in order to target the territories in which protection is opportune and/or strategic.

Several criteria can be taken into consideration to determine the country or countries in which protection will be claimed:

  • business location;

  • potential or future markets ;

  • the country or countries in which partnerships and agreements are envisaged (licensing...
